Overview

Welcome to StepUp. These Terms and Conditions govern your access to and use of the StepUp mobile application.

By downloading, installing, accessing, or using StepUp, you agree to these Terms. If you do not agree, please do not use the App.

Purpose of StepUp

StepUp is a fitness and activity tracking application designed to help users monitor their movement, physical activities, and fitness progress.

Depending on the version of the App, StepUp may provide features such as step tracking, daily activity tracking, fitness goals, streaks, activity history, walking, running, hiking, cycling or other activity tracking, GPS route recording, distance calculation, pace and speed information, estimated calorie information, maps and routes, achievements, badges, leaderboards, community functionality, notifications, and other health, fitness, and wellness-related features.

Features may be added, modified, suspended, or removed over time.

StepUp Does Not Provide Medical Advice

StepUp is intended for general fitness, wellness, and informational purposes only.

StepUp is not a medical device and does not provide medical diagnoses, medical treatment, medical advice, professional healthcare recommendations, or emergency medical services.

Information displayed by StepUp, including step counts, activity statistics, distance, estimated calories, pace, speed, goals, trends, or other fitness measurements, should not be interpreted as professional medical advice.

You should consult a qualified healthcare professional regarding medical conditions, symptoms, treatment, exercise suitability, or other health concerns. If you experience symptoms that cause concern during physical activity, stop exercising and seek appropriate medical attention.

Accuracy of Fitness Information

StepUp relies on technology including device sensors, GPS, Apple HealthKit, Motion & Fitness services, location services, mapping providers, network services, and other device and third-party technologies.

Activity measurements may be affected by device hardware, device placement, sensor accuracy, GPS accuracy, environmental conditions, network availability, permission settings, battery-saving settings, operating-system behavior, and third-party service availability.

StepUp does not guarantee that step counts, distance, routes, calories, speed, pace, elevation, or other measurements will always be completely accurate.

StepUp should not be relied upon for medical, emergency, safety-critical, or navigation-critical decisions.

HealthKit and Motion & Fitness

Certain StepUp features may require permission to access information through Apple HealthKit or Apple's Motion & Fitness services.

You decide whether to grant these permissions. If you deny or revoke access, features dependent on that information may become unavailable or may provide limited functionality.

Your use of Apple HealthKit and other Apple services is also subject to Apple's applicable terms, policies, and privacy controls.

Location Services

Outdoor activity tracking and related features may require access to your device location.

Location services may be used to track outdoor activities, record routes, calculate distances, calculate movement, display your location, display activity routes, provide maps, process routes, and provide destination-related functionality.

GPS, maps, routes, and geographic information may occasionally be delayed, incomplete, or inaccurate. You remain responsible for your personal safety and surroundings while using StepUp.

Safe Use of StepUp

Always use StepUp safely and responsibly. Pay attention to traffic, vehicles, pedestrians, road conditions, weather, terrain, your physical condition, and your surroundings.

Do not interact with StepUp in a way that distracts you or creates a safety risk while walking, running, cycling, driving, crossing roads, or participating in another physical activity.

Never follow a map, route, activity goal, challenge, notification, or other StepUp recommendation if doing so would be unsafe.

User Responsibilities

You agree to use StepUp only for lawful purposes.

You must not use StepUp for illegal activities, interfere with the operation of the App, attempt unauthorized access, circumvent security features, introduce malicious software, manipulate activity information for fraudulent purposes, manipulate leaderboard results, abuse achievements or reward systems, harass or threaten other users, impersonate another person, upload unlawful material, violate another person's privacy or intellectual-property rights, use automated systems to abuse StepUp services, or reverse engineer StepUp except where expressly allowed under applicable law.

Profiles and Community Features

StepUp may provide functionality such as user profiles, community feeds, activity posts, comments, reactions, leaderboards, and shared fitness statistics.

Information you intentionally make public through these features may be visible to other StepUp users. You should not publish information that you do not want others to see.

You must not publish illegal, threatening, harassing, abusive, privacy-violating, or intellectual-property-infringing content, or sensitive personal information belonging to another person.

We may restrict access to community functionality or remove content where reasonably necessary to enforce these Terms, protect users, protect StepUp, or comply with applicable law.

User Content

You retain ownership of content that you create and submit through StepUp.

When you intentionally submit or publish content through StepUp's community functionality, you grant StepUp a limited, non-exclusive right to host, store, process, display, and transmit the content only to the extent reasonably necessary to provide StepUp's functionality.

This permission generally ends when the content is deleted, subject to reasonable technical backups, security requirements, legal obligations, and other legitimate retention requirements.

Third-Party Services

StepUp may integrate with or rely on third-party services. Depending on the features provided, these may include services from Apple, Google, Firebase, Google Maps, Mapbox, OpenStreetMap, and other infrastructure, mapping, or technology providers.

Third-party services are outside StepUp's complete control. Their availability, reliability, accuracy, and handling of information may be governed by their respective terms and privacy policies.

We are not responsible for outages or changes to third-party services beyond our reasonable control.

Internet and Device Requirements

Some StepUp features may require an internet connection, GPS, motion sensors, health permissions, Motion & Fitness permissions, location permissions, notification permissions, supported hardware, and a compatible operating-system version.

You are responsible for your device and any mobile-data, internet, telecommunications, or other charges associated with using StepUp.

Availability of StepUp

We aim to provide a reliable App but cannot guarantee uninterrupted operation.

StepUp may occasionally be unavailable because of maintenance, software updates, server interruptions, network failures, third-party service failures, operating-system changes, hardware limitations, security requirements, technical problems, or circumstances outside our reasonable control.

Features may change over time.

Intellectual Property

Except for user-generated content and third-party materials, StepUp and its associated software, user interface, design, graphics, branding, logos, content, features, and documentation are owned by or licensed for use by StepUp and are protected by applicable intellectual-property laws.

You are granted a limited, personal, non-exclusive, non-transferable, and revocable right to use StepUp for its intended purpose. No ownership rights are transferred to you.

Privacy

Your use of StepUp is also governed by the StepUp Privacy Policy.

The Privacy Policy explains how StepUp may handle information including health information, fitness information, motion information, location information, activity information, profile information, community information, and technical information.

Account or Service Restrictions

You may stop using StepUp at any time.

Where StepUp provides online accounts or community services, we may suspend, restrict, or terminate access to certain functionality when reasonably necessary if a user seriously violates these Terms, abuses StepUp services, commits or attempts fraud, threatens other users, threatens StepUp's infrastructure or security, or uses StepUp unlawfully.

Any restriction will be applied subject to applicable law.

Disclaimer of Warranties

To the maximum extent permitted by applicable law, StepUp is provided on an “as is” and “as available” basis.

We do not guarantee that StepUp will always be available, activity measurements will always be accurate, GPS information or maps will always be accurate, StepUp will always be error-free, third-party services will always be available, every feature will work on every device, or StepUp will meet every user's individual fitness goals.

Nothing in these Terms excludes consumer rights or warranties that cannot legally be excluded.

Limitation of Liability

To the maximum extent permitted by applicable law, StepUp will not be responsible for indirect, incidental, special, consequential, or similar damages resulting from your use of or inability to use the App.

This may include losses resulting from inaccurate fitness measurements, inaccurate step counts, GPS inaccuracies, incorrect route information, loss of activity history, network outages, third-party service failures, device failures, or decisions made based on information displayed by StepUp.

Nothing in these Terms limits liability where such limitation is prohibited under applicable law.

Emergency Situations

StepUp is not an emergency service.

Do not rely on StepUp to contact emergency services, detect medical emergencies, determine whether an activity is medically safe, provide emergency navigation, or provide medical treatment.

In an emergency, contact the appropriate local emergency service.

Changes to These Terms

We may update these Terms when StepUp's functionality, technology, legal requirements, or services change.

When these Terms are updated, the “Last Updated” date at the top of this page will be revised.

If applicable law requires additional notice or consent, appropriate steps will be taken.

Governing Law

These Terms are governed by applicable laws of the United States, subject to any mandatory consumer-protection laws or rights that may apply to you based on your location.
